What is the eviction process in Ontario?
The Eviction Process:
1: The Landlord must give 60 days notice
2. Provide Reason For Eviction
3: Give Tenant Written Notice
4. Must use Official LTB Forms
Guidelines to Vacate Tenant
Landlords selling their rental property must:
- provide Tenant with equivalent of one month’s rent, or offer the Tenant another unit if they:
- want to use the unit themselves or for a family member
- are selling the property and the purchaser will be using the unit themselves
Landlord renovating, repair or demolish their property must do the following:
- give the equivalent of one month’s rent
- provide the Tenant with first right of refusal to move back into the unit following the renovation
- Landlord note: now it is two years and not one for a Tenant to file a claim if you fail to provide right of first refusal

A landlord cannot evict a tenant by legal means without a hearing before the LTG.
Non payment of rent tends to the majority of cases before the LTB and landlords applications to evict these tenants as a result. Circumstances of the tenant come to play when the LTB considers an order of eviction or to grant relief from eviction. Tenants have little defence against invitation after the Ontario Government passed Bill 184 in July 2002 which has now made it easier for Landlords to evict Tenants facing financial difficulties. LTB adjudicators of the LTB are landlords, past and present employees of landlords and supporters of the landlord lobby. They are appointed by the Province of Ontario to adjudicate the LTB and people with legal and non legal backgrounds are included. As if March 2021, there are 39 full time adjudicators and 35 part time adjudicators hired in November 2020 to listen to LTB matters. There was a period of time from March 19, 2020 where the Ontario Superior Court suspended residential evictions however as of Aug 1, 2020, the LTB has resumed hearings of all applications including evictions for rent arrears. As of January 13, 2020, the Government of Ontario made “O.Reg. 13/21 Residential Evictions” O. Reg. 13/21: RESIDENTIAL EVICTIONS (ontario.ca) Now the Sheriff cannot enforce an LTB eviction order unless the Sheriff is specifically given the order to expedite the eviction.
